General

At Hom Technologies, Inc., we care about your personal information, so we have prepared this Privacy Policy to explain how we collect, use, and share it. This Privacy Policy applies to hōm websites, mobile apps, and related services (“Service”). By using the Service, you agree with hōm’s collection, use, and sharing of your personal information in accordance with the terms of this Privacy Policy.

Please note that hōm is constantly testing and improving our product features. Any features discussed in this Privacy Policy may not be available to all users or in all jurisdictions.


Information We Collect

When you use the Service, hōm may collect the following personal information about you.

Account Registration

To register for a hōm account, you must use certain social logins, such as Google and Apple. If you register for hōm using a social login, hōm may receive information about you from your social login provider, such as your name & email address.

You can manage your hōm account and social logins from the Settings page in the app.

User Profile

After you register for your hōm account, a profile will be created for you (“Profile”). Your Profile will be populated by information you submit, such as your name, email address, phone number, and home address.

Your Profile will also include information about your history of usage of the app, such as the projects you have or are working through and any engagements with professionals you have or are coordinating.

hōm may scan or review any User-Generated Content, or share your User-Generated Content with a third-party content moderation service provider, to ensure compliance. hōm may restrict or delete User-Generated Content for any reason.

Conversations

You may interact with our Artificial Intelligence (“AI”) features, including those that allow you to send text or audio messages to an AI chat companion in an open-ended conversational format.

When you interact with AI features, your information may be shared with a third-party provider such as Google, Apple, or Amazon Web Services, as well as AI vendors such as OpenAI, which may keep a copy of your text or audio responses for their own purposes. Please do not submit any personal or confidential information when using AI features.

Images

We may sample images to provide you with information about the physical space you're in. For example, we may recognize objects in your environment like toilets, sinks, etc. and we can detect the presence of those objects to aid your AI conversation.

Sampled images are primarily processed and stored on your device. However, at our discretion, image information may be transmitted off-device to our servers for a variety of reasons, such as facilitating automated coordination with service professionals at your request and improving the capabilities of our vision algorithms.

Once off-device, this image information may be shared with a third-party provider such as a service professional, cloud services like Google, Apple, or Amazon Web Services, as well as AI vendors such as OpenAI, which may keep a copy of your image for their own purposes. 

Activity Data & IP Addresses

When you use the Service, we may generate data about your use of the Service, which may include your browser and device data, log data, and IP address. We will also generate data regarding your engagement in core activities on the Service.

Cookies

When you access the hōm website, we store certain data from your browser using cookies. A cookie is a piece of data stored on the user’s computer tied to data about the user. We use session ID cookies to confirm that users are logged in. 

We and our third-party vendors may use cookies, clear GIFs, pixel tags, and other technologies that help us better understand User behavior, personalize preferences, perform research and analytics, and improve the Service. These technologies, for example, may allow us to tailor the Service to your needs, save your password in password-protected areas, track the pages you visit, help us manage content, and compile statistics about Service usage. We also use certain of these technologies to deliver advertisements through the Service that may interest you or to advertise ourselves and the Service to you on other sites. We or our third-party vendors also may use certain of these technologies in emails to our users to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but your browser may allow you to modify your browser settings to decline cookies if you prefer. If you disable cookies, you may be prevented from taking full advantage of the Platform, because it may not function properly. As we adopt additional technologies, we may also gather additional information through other methods.

MixPanel

We use MixPanel, which is a web analytics tool that helps us understand how users engage with our website. Like many services, MixPanel uses first-party cookies to track user interactions, as in our case, where they are used to collect information about how users use our site. This information is used to compile reports and to help us improve our site. These reports disclose website trends without identifying individual visitors. Supplemental information

To the extent permitted by law, we may, in our sole discretion, ask for and collect supplemental information about you from non-affiliated sources, such as information about your credit from a credit bureau, or information to verify your identity or trustworthiness, or for other fraud or safety protection purposes. We may combine information that we collect from you through the Platform with information that we obtain from such sources, including public information sources and information derived from any other products or services we provide.

We may collect information that demonstrates the occurrence of an off-Service communication between a User and a Professional in order to ensure accurate charging of fees imposed upon Professionals and to enforce the Terms of Use. Except as explicitly stated herein, we will not collect or store the contents of any off-Service communication between a User and a Professional.

If you send text messages with a User or Professional using the telephone number for that User available on the Service, we may use a third-party vendor to track these text messages. We track these text messages for fraud prevention, to ensure appropriate charging of fees, to enforce our Terms of Use, and for quality and training purposes. As part of this process, hōm and the third-party vendor will receive in real time and store data about your text message, including the date and time of the text message, your phone number, and the content of the text message.


How We Process Your Information

hōm may process your personal information according to the following legal bases: to provide products or services you request, to promote hōm’s legitimate interests, to comply with legal obligations, and with your consent. In particular, hōm may process and share your personal information in the following ways:

Providing and improving the Service

hōm will process your personal information to provide and improve the Service. For example, we will use the information you provide to maintain your Profile, personalize content, detect and fix bugs, perform research, and provide customer service to you.

At your request, hōm may share your personal information with Professionals who may use your information to coordinate a consultation or appointment to help you with a home maintenance issue. These Professionals may have access to personal information that is necessary to perform their functions, but they are only permitted to do so in connection with performing services for us. They are not authorized by us to use the information for their own benefit.

hōm may share personal information with third parties that help us provide or improve the Service, including hosting providers such as Amazon Web Services, search engine providers such as Google, analytics providers such as Crashlytics, support providers such as ZenDesk, and payment processors such as Stripe. hōm may also share your information with third-party vendors that support product features such as AI, speech recognition, image recognition, and content moderation.

If you redeem a promotion code to gain a hōm subscription, we may share data regarding your usage of hōm with the organization that provided the promotion code to you.

Communicating with you

hōm will use the email address or phone number you provide to send you the following types of messages:

  • Essential messages to support the operation of the Service.

  • Messages to support & reinforce your learning, such as home maintenance tips, reminders, and progress reports.

  • Announcements regarding changes to the Service or products.

  • Announcements of new hōm products, services, offers, or research opportunities.

Complying with law and preventing harmful activities

hōm may process and share personal information if necessary to comply with legal requests, such as subpoenas or court orders. hōm may share personal information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity, to assist law enforcement, or to prevent imminent harm. This may include sharing information with other companies, lawyers, agents, or government agencies.

Personalized advertising

hōm may process and share your personal information for the purpose of providing you with personalized advertising. To provide personalized advertising, we work with a variety of third-party advertising networks, marketing analytics service providers, and website analysis firms, such as Google and Facebook. These third-party advertising service providers collect and use personal information about your visits to and use of the Service, as well as other websites, in order to serve you with advertisements and content tailored to meet your preferences and likely interests, and better understand ad effectiveness. Aggregate demographic and interest data will also be used for market research purposes.

You may be able to opt out of receiving personalized ads from advertisers and ad networks that are members of the Network Advertising Initiative or who follow the DAA Self-Regulatory Principles for Online Behavioral Advertising using their respective opt-out tools hyperlinked above. In addition, your mobile devices may offer settings that let you make choices about the collection, use, and transfer of mobile app information for personalized ads (for example, Apple iOS’ Advertising ID and Google Android’s Advertising ID).

Please note that opting out of personalized advertising does not prevent the display of all advertisements to you.

Anonymous information

hōm may process aggregated, de-identified, or otherwise anonymous or anonymized information for any purpose. Such information is not considered personal information.

Your Data Subject Rights

You also have the following rights in relation to the personal information we hold about you, in addition to any other rights required by applicable law:

  • Know what personal information we have collected about you.

  • Access a copy of the personal information that we hold about you.

  • Know what personal information about you we have shared with third parties.

  • Opt out of the sharing of your personal information with third parties.

  • Object to our processing of your personal information.

  • Request that we limit our use of your sensitive personal information to what is necessary to perform the services you requested.

  • Not be discriminated against for exercising your data subject rights.

  • Request that we delete any personal information we have collected from you.

  • Request that we correct any inaccurate personal information about you.

  • Export the personal information you have provided to hōm in a format that can be transferred electronically to a third party.

  • Withdraw any consent you previously gave us to process your personal information.

  • Delete your hōm account.

You may update or correct your information, and exercise certain opt-out rights, in your Settings page in the hōm app. To make any other privacy-related request, please send an email to [email protected]

Please note that these rights are not absolute and hōm may refuse requests to exercise data subject rights if there is a legitimate reason, such as if we cannot authenticate your identity, if the request could violate the rights of a third party or applicable law, or if the request could interfere with a hōm service or prevent us from delivering a service you requested.

Data Retention

hōm will generally retain your personal information until your account is deleted. However, hōm may retain certain information longer if necessary to provide our Service, defend our legitimate interests or those of third parties, comply with legal requirements, resolve or defend ourselves in disputes, investigate misuse or disruption of the Service, or perform agreements. Even if we delete some or all of your information, we may continue to retain and use anonymous or aggregate data, or any other data that constitutes non-personal information, indefinitely. Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.

Security

We employ physical, procedural, and technological security measures to help protect your information from unauthorized access or disclosure. hōm may use encryption, passwords, and physical security measures to help protect your information against unauthorized access and disclosure. No security measures, however, are 100% failsafe. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that any information provided or transmitted online is completely secure. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. We are not responsible for the unauthorized use of your information nor for any lost, stolen, or compromised passwords, or for any activity on your account via unauthorized password activity.

Child Users

The Service is intended for users ages 18 and over, and we do not knowingly collect personal information from children under the age of 16. When we become aware that personal information (or other information that is protected under applicable law) from a child under 16 has been collected, we will use all reasonable efforts to delete such information from our databases. Do Not Track

The Service is not designed to respond to “do not track” signals sent by some browsers.

Links to Third-Party Websites

The Service may contain links to other websites. hōm is not responsible for the content or privacy practices of other websites, including any personal or financial information collected by third-party payment processors. We encourage users to be aware of the privacy policies of other websites they visit. This Privacy Policy applies only to information collected by hōm. Any time you click on a link (including advertising banners) or submit your personal information to a third-party website, you will be subject to that third party’s privacy policies.

Privacy Policy Updates

We may update our Privacy Policy to reflect changes to our information practices. If we do this and the changes are material, we will post a notice that we have made changes to this Privacy Policy on the Website for at least seven (7) days before the changes are made, and we will indicate at the top of the Privacy Policy the date these terms were last revised. Any revisions to this Privacy Policy will become effective at the end of that seven (7) day period.

Data Transfer

hōm is based in the United States and processes data in the United States, which may not provide equivalent levels of data protection as your home jurisdiction.

If you submit personal information to us, that information may be processed in a jurisdiction where privacy laws may be less stringent than those in your country of residence. By submitting your personal information to us, you agree to the transfer, storage, and processing of such information in foreign jurisdictions including, but not limited to, the United States. Please note that personal information transferred to the United States is subject to access by law enforcement.

Supplemental Terms in Certain Jurisdictions

In some jurisdictions, the Service may be subject to supplemental privacy policies or local laws. For users in those jurisdictions, the applicable supplemental privacy policies and local laws will take precedence over this Privacy Policy to the extent they conflict.
